Tarmac Delay Contingency Plan Due to the US DOT by Monday, May 15, 2017.

As a reminder, the FAA Modernization and Reform Act of 2012 requires large, medium, small and non-hub U.S. airports to submit updated tarmac delay contingency plans to the Department of Transportation for review and approval. Covered airports are required to submit an updated plan to the Department for review and approval by this upcoming Monday, May 15, 2017. 

Airports should submit their plans through the following website: http://filingtarmacdelayplan.dot.gov. If an airport is submitting a plan for the first time, it must register and create an account at the link above by doing the following:  1) click the hyperlink titled “Create Account to Submit Tarmac Delay Contingency Plan” in the blue sign-in box on the home page of the established website; 2) select “Airport” and locate your airport in the drop-down menu, and 3) click “submit” to be taken to the registration screen. In the event an airport operator needs to develop an entirely new Plan, ACI-NA has created a template that was developed in collaboration with the U.S. DOT. Because of unique differences in the physical characteristics and capabilities of airports as well as differences in the terms of their leases with air carriers and other tenants, the template provides several versions of suggested text for the various sections required in the plan.  Airport operators are encouraged to model their plan after an option that best matches their individual circumstances.

The Enforcement Office will have 60 days from receipt of a plan to review and approve a plan or, if necessary, require modifications to the updated plan. 49 U.S.C. § 42301(e)(1). If the Enforcement Office fails to approve or require modifications to an updated plan within the 60-day timeframe, the plan shall be deemed approved. 49 U.S.C. § 42301(e)(2).  More detailed instructions regarding creating an account and submitting plans can be found at www.dot.gov/airconsumer/flight-delays
