Update on ACI-NA Webinar on American-US Airways Merger

Many of you participated in yesterday’s webinar on the Department of Justice Antitrust Lawsuit and its Impact on the Proposed American Airlines – US Airways Merger.  We were very pleased with the participation – close to 100 members participated in all or part of the webinar.

We wanted to provide you updated information as well as the link for the webinar recording, in the event you would like to distribute this information to your staff.

Today Judge Colleen Kollar-Kotelly, the judge assigned to the antitrust litigation challenging the proposed merger of US Airways and American Airlines, issued a Scheduling Order.  The most significant date is that of the trial, which has been scheduled to begin on Monday, November 25, 2013.   Counsel for the airlines had requested a commencement date of November 12, 2013, and counsel for the government had requested a trial date of March 3, 2014.The trial is expected to last 10 to 12 days.

Other important dates are shown below:

  • September 4, 2013, the date by which the parties must file a joint proposed order concerning referral of discover disputes to a special master.
  • September 30, 2013, the date by which the parties must file a joint status report of outstanding issues the Court needs to address.
  • October 1, 2013, the date of the next status hearing in the case, when the parties will discuss trial procedures and pre- and post-trial briefing.

It appears that the case may be decided prior to year-end.
